Several attacks on the federal government’s power under the Commerce Clause have failed. Despite these attacks, the law continues to enforce its own policies on illegal Internet gambling. Because the commerce clause protects a business’s commercial activities, the question of whether a state can ban gambling on its borders has been raised.

Another issue is the Due Process Clause. While state laws can regulate gambling that occurs partially in a foreign country, the Constitution guarantees free speech, which is also subject to state laws. State officials have expressed concern that Internet gambling can spread to their jurisdictions. That concern has prompted some to seek to limit the reach of federal criminal penalties on Internet gambling, and some states have begun to write their own legislation on online gambling.

As a result of these constitutional concerns, Congress has adopted the Lopez Amendment. It is designed to curb low-level gambling crimes by putting additional elements in place to weed out cases that do not involve a substantial commercial activity.

The Lopez Amendment also provides for the regulation of commercial activity. For example, the Attorney General can’t accept financial instruments from illegal Internet bets. Additionally, the Lopez Amendment prohibits the use of a common carrier to facilitate illegal Internet gambling.

As technology advances, the gambling industry continues to expand. Today, there are more ways to bet on a sports game or play a game of poker than ever before. And with the advent of new games, the competitiveness of the game has become increasingly creative.
